Terms of Service

Please read these Terms of Service ("Terms") carefully before using TrackMyElo.com ("the Service", "we", "us", or "our"). By accessing or using the Service in any way — including creating an account, browsing the website, or using any feature — you agree to be bound by these Terms. If you do not agree to all of these Terms, you must immediately stop using the Service.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Service. We do not knowingly collect personal information from children under 13; if we become aware that a child under 13 has provided personal information, we will delete it.

2. Accounts and responsibilities

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, whether or not authorized by you. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to safeguard your account.

3. Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service for any illegal purpose or in violation of any applicable local, national, or international law or regulation.
  • Harass, abuse, threaten, stalk, intimidate, or harm any person.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Attempt to gain unauthorized access to the Service, its servers, or any related systems or networks.
  • Circumvent, disable, or otherwise interfere with any security features of the Service.
  • Transmit any unsolicited commercial communications, spam, or malware.
  • Scrape, crawl, index, or otherwise extract data from the Service by automated means without our prior written consent.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Upload or transmit content that is defamatory, obscene, or otherwise objectionable.
  • Use the Service in any way that could disable, overburden, or impair its proper operation.

We reserve the right to terminate or suspend your access immediately, without prior notice or liability, for any violation of these Terms or for any other reason at our sole discretion.

4. User content and third-party data responsibility

You retain ownership of any content you submit to the Service (league names, player names, match data, etc.). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to store, display, and process that content solely for the purpose of providing the Service to you.

You represent and warrant that: (a) you have all rights necessary to submit the content; (b) your content does not violate any third-party rights, including privacy, intellectual property, or publicity rights; and (c) where you enter names, identifiers, or any information relating to third parties (such as player names in a league), you have the authority or consent to do so, and you take full legal responsibility for that data. We are a passive conduit for such content and bear no responsibility for the accuracy, legality, or appropriateness of third-party information entered by users.

We are not responsible for any content submitted by users and reserve the right to remove any content that we determine, in our sole discretion, violates these Terms or applicable law.

5. Service availability and modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice, for any reason including maintenance, upgrades, or business decisions. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service. We do not guarantee that the Service will be available at any particular time or that it will be error-free.

6. Free tier limitations

  • Free accounts may own up to 3 leagues.
  • Free accounts may be a member of up to 3 shared leagues owned by others.
  • We reserve the right to change these limits at any time with reasonable notice.

7. Intellectual property

The Service, including its design, code, logos, and all content created by us (excluding user-submitted content), is owned by or licensed to TrackMyElo and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our prior written permission.

8. Third-party services

The Service integrates with third-party services (including Clerk for authentication and Amazon Web Services for data storage). Your use of those services is governed by their respective terms and privacy policies. We have no control over, and assume no responsibility for, the content, policies, or practices of any third-party services.

9. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT ANY DATA YOU STORE ON THE SERVICE WILL BE RETAINED, ACCURATE, OR RECOVERABLE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRACKMYELO, ITS OPERATORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR ANY OTHER INTANGIBLE LOSS, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) FIFTY DOLLARS (USD $50). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

11. Indemnification

You agree to defend, indemnify, and hold harmless TrackMyElo and its operators, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including privacy or intellectual property rights; or (d) any content you submit to the Service.

12. Data loss

You acknowledge that we are not responsible for any loss of data. You are solely responsible for maintaining backups of your data. The Service provides an export feature for your convenience, and we strongly recommend using it regularly. We make no guarantees regarding data availability, durability, or recovery in the event of system failures, bugs, or service discontinuation.

12. Data loss acknowledgment

You acknowledge and agree that: (a) we are not responsible for any loss, corruption, or unavailability of data stored through the Service; (b) you are solely responsible for maintaining independent backups of your data (the Service provides an export feature for this purpose); (c) in the event of service discontinuation, technical failure, or account deletion, your data may be permanently lost; and (d) we make no guarantee of data durability, availability, or recoverability.

13. Children (COPPA compliance)

The Service is intended for users aged 13 and older. We do not knowingly allow children under 13 to create accounts or use the Service. If you are a parent or guardian and believe your child under 13 has registered, contact us immediately and we will terminate the account and delete associated data. If you are under 13, do not use the Service or submit any personal information.

14. Governing law and dispute resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved exclusively through binding individual arbitration (not class action) under the rules of the American Arbitration Association, unless prohibited by law in your jurisdiction. You waive any right to participate in a class action lawsuit or class-wide arbitration. Nothing in this section prevents either party from seeking injunctive or other equitable relief for intellectual property infringement or misuse.

15. EU/UK users

If you are located in the European Economic Area, United Kingdom, or Switzerland, you have additional rights with respect to your personal data as described in our Privacy Policy. Nothing in these Terms limits rights you may have under applicable data protection law that cannot be contractually excluded. To the extent these Terms conflict with any mandatory consumer protection laws in your jurisdiction, those laws prevail.

16. Changes to these terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.

17. Severability and entire agreement

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and TrackMyElo with respect to the Service and supersede all prior agreements.
